FTC Sues Amazon, Alleging Illegal ‘Dark Patterns’ Trapped Millions in Prime Subscriptions

The U.S. Federal Trade Commission (FTC) has filed a significant lawsuit against Amazon, accusing the e-commerce and cloud computing giant of engaging in a years-long effort to illegally enroll consumers in its Amazon Prime subscription service without consent. The complaint, filed in the U.S. District Court for the Western District of Washington, alleges that Amazon used manipulative, coercive, and deceptive user-interface designs known as “dark patterns” to trick users into signing up for automatically-renewing Prime subscriptions.

According to the FTC, Amazon’s checkout process was designed to push customers toward subscribing to Prime, often making it unclear that they were agreeing to a recurring charge. The lawsuit further claims that the company knowingly complicated the cancellation process to retain subscribers who wished to leave the service. Internal documents reportedly reveal that Amazon executives codenamed this intentionally difficult cancellation flow “Iliad,” after the epic Greek poem about the long, arduous Trojan War, fully aware of the friction it created for customers.

FTC Chair Lina Khan stated, “Amazon tricked and trapped people into recurring subscriptions without their consent, not only frustrating users but also costing them significant money.” The legal action seeks monetary civil penalties and a permanent injunction to prevent Amazon from engaging in these alleged deceptive practices in the future.

This lawsuit represents a major escalation in the regulatory scrutiny faced by Amazon and is a cornerstone of the Biden administration’s broader effort to rein in the market power of Big Tech. The outcome could have far-reaching implications for subscription-based business models across the digital economy, potentially setting new standards for transparency and user consent in online transactions. Amazon has stated that the FTC’s claims are false on the facts and the law.
