ByteDance Rejects Sale of TikTok, Vows to Fight US Divest-or-Ban Law in Court

ByteDance, the Chinese parent company of TikTok, has officially confirmed it has no intention of selling the popular short-form video app, setting the stage for a landmark legal confrontation with the United States government. The statement, posted on the company’s official Toutiao account, directly refutes speculation that it was seeking a buyer for TikTok’s U.S. operations following the passage of a new American law.

The law, officially titled the “Protecting Americans from Foreign Adversary Controlled Applications Act,” gives ByteDance approximately nine months to divest its ownership of TikTok’s U.S. assets or face a complete ban on the app within the country. The legislation stems from bipartisan concerns in Washington over national security, with lawmakers worried that the Chinese government could compel ByteDance to hand over data on its 170 million American users or manipulate the content they see.

In its statement, ByteDance clarified that while it has explored scenarios for the future of its U.S. operations, a sale is not on the table. The company has consistently denied allegations of data sharing with the Chinese government and argues that the divest-or-ban law is unconstitutional, infringing on free speech rights.

The core of the dispute centers on TikTok’s powerful recommendation algorithm, which ByteDance considers a crown jewel of its intellectual property and is unwilling to part with. Any sale without this algorithm would render the U.S. version of TikTok a shell of its current self, making it an unattractive asset for potential buyers.

With a sale firmly off the table, ByteDance is now channeling its efforts into a legal challenge against the U.S. law. This move signals the beginning of what is expected to be a prolonged and high-stakes court battle, the outcome of which could reshape the digital landscape and redefine how the U.S. government regulates foreign-owned technology platforms.
